1719 DEED OF JOHN SCARFE
North Carolina. To all people to, whom those present come I john Smithson of the precinct of
Pasquotank to persons aforesaid send greeting. Now know ye that I the said John Smithson for divers
causes and considerations me hereunto moving, but more especially for the valuable consideration
of twenty four pounds to me in hand paid or secured to be paid by John Scarfe of the precinct and
province aforesaid the receipt whereby I acknowledge and thereof and of every part and paid thereof
do fully deed and absolutely acquit and discharge the said John Scarfe his heirs Executores
Adminitrators and Assignees by these present have given granted, bargained sold aliened enscoffed
confirmed and made over and do hereby give grant bargain sell alien enscoff confirm and make over
forever unto the said Scarfe his heirs Executors Administrators Asignees a certain piece or parcel
of land of one hundred acres of land more or less lying and being situated on the southwest side of
Pasquotank River known by the name of the Deep Branch and part of a greater tract by patent
granted to Thomas Abbington and by him sold to Richard Marden and Alex Lefear and by him sold
to Jonathan Jacobs and by him sold to John Smithson and by him sold to the said Scarfe and his heirs
Administrators and Assignees forever, with all houses or sheds garden fences pastures woodland
ground appertenances to the same belonging with all uses customs profits benefits privileges and
other attainments thereunto appertaining. To have and to hold the said 100 acres of land or plantation
more or less with all or singular the uses customs profits or privileges thereunto bargained and sold
to the only use benefit and likes of him the said John Scarfe, his heirs Executors Administrators and
Assigness forever and I the said John Smithson for me my heirs Executors, Administrators and
Assignees, do hereby covenant grant and agree to and with the said John Scarfe his heirs Executors
Administrators and Assigness, that I the said John Smithson this before granted bargained or sold,
shall and will from time to time and at all times forever hereafter warrant maintain and defend from
the claim right of or title or pretended claim right or title of any person or persons whatsoever or
from the claim right or title of me my heirs Executors Administrators or from any person or persons
from by or under them or any or either of them. And I the said John Smithson do oblige myself my
heirs Executors Administrators and to the said John Scarfe his heirs Executors Administrators and
Assignees to make do execute or perform or cause to be made done executed and performed any
other or further act or acts deed or deeds devise assurance or assurances whatsoever in the law for
the further or better assuring or sure nothing of the before granted premises as the said John Scarfe
his heirs Executors Administrators and Assignees their learned in the law shall reasonably advise
devise or require. And lastly the said John Scarfe his heirs Executors Administrators and Assignees
shall and may from time to time and at all times forever hereafter have hold use occupy or peacably
possess and enjoy the before granted premises. l bind my heirs Executors Administrators firmly by
these present. As witness hand and seal the 9 day of July 1719.
